SwimDNA Terms of Use

1. Acceptance of Terms

By accessing or using SwimDNA, you agree to these Terms of Use.

If you do not agree with these Terms, you must not use the platform.

2. Description of Service

SwimDNA provides swimming performance analytics, athlete development insights, comparison tools, forecasting models, and related services.

SwimDNA is an informational and analytical platform only.

SwimDNA does not provide coaching, medical advice, professional sporting advice, or guarantees of future performance.

3. User Accounts

Users are responsible for:

  • Maintaining the security of their account
  • Keeping login credentials confidential
  • Ensuring information provided is accurate

Users must not:

  • Share accounts
  • Attempt unauthorised access
  • Disrupt platform operation
  • Use the platform for unlawful purposes

4. Subscription Services

Certain features require a paid SwimDNA Premium subscription. Prices are stated in Australian dollars (AUD) and, where applicable, include GST.

  • Premium is offered as an auto-renewing monthly or annual subscription, billed securely through Stripe. We never see or store your card details.
  • New subscriptions start with a 7-day free trial. A payment method is required to start the trial, and the subscription converts to a paid plan when the trial ends unless you cancel before then — cancel within the trial and you pay nothing.
  • You can cancel any time from billing settings. Access continues to the end of the period you've paid for; no further charges are made after cancellation.
  • Subscription pricing and included features may change from time to time. Price changes will be notified in advance and never applied silently to an existing subscription period.

5. Performance Analytics Disclaimer

SwimDNA provides estimates, forecasts, rankings, projections, and performance insights based on available data.

These outputs are analytical opinions generated by software models and should not be interpreted as guarantees.

Examples include:

  • Qualification probability
  • Future performance estimates
  • Improvement forecasts
  • Event suitability recommendations

Actual performance outcomes may differ significantly.

6. Public Competition Results

SwimDNA may use publicly available competition results to generate analytics.

Users acknowledge that public competition results may originate from third-party organisations and may contain inaccuracies or omissions.

7. Intellectual Property

All SwimDNA software, branding, analytics methodologies, algorithms, reports, visualisations, and proprietary metrics remain the property of SwimDNA.

Users may not:

  • Copy substantial portions of the platform
  • Reverse engineer proprietary systems
  • Reproduce SwimDNA analytics for commercial purposes without permission

8. Availability

SwimDNA aims to provide reliable service but does not guarantee uninterrupted availability.

Features may be modified, suspended, or discontinued at any time.

9. Limitation of Liability

To the maximum extent permitted by law:

SwimDNA shall not be liable for any indirect, incidental, consequential, or special damages arising from use of the platform.

Users use SwimDNA at their own risk.

10. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any rights or remedies that cannot be excluded under Australian Consumer Law.

11. Termination

We may suspend or terminate access where users:

  • Breach these Terms
  • Misuse the platform
  • Engage in unlawful activity

Users may cease using SwimDNA at any time.

12. Changes to Terms

We may update these Terms from time to time.

Continued use of SwimDNA after changes are published constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of New South Wales, Australia.

Any disputes shall be subject to the jurisdiction of the courts of New South Wales.
